Overview
Private class actions “provide a significant supplement to the limited resources available to the Department of Justice for enforcing the antitrust laws and deterring violations.” Reiter v. Sonotone Corp., 442 U.S. 330 (1979).
Building on Milberg’s platform as one of the nation’s most outstanding plaintiffs' law firms, the Firm’s Antitrust Practice Group prosecutes large, often complex antitrust and trade regulation class actions and other cases that target some of the most powerful and well-funded corporate interests in the world. These cases frequently bring to light concealed unlawful conduct such as price-fixing, monopolization, monopoly leveraging, tying arrangements, exclusive dealing, and refusals to deal.
The importance of the United States antitrust laws to worldwide markets is illustrated by the degree to which European and other countries have modified their own, internal laws in recent years to pattern them more closely after American law. Although private enforcement and private remedies still lag far behind the U.S. in nearly all other countries, future developments may extend that influence of American law to embrace matters of procedure and enforcement as well. For example, Mario Monti, the former head antitrust enforcement official of the European Union, stated in April 2004 that he hopes to promote the development of “U.S.-style class actions” in Europe to supplement government enforcement powers that currently exist there. Unless and until such legal changes abroad are made, however, the only effective mechanism that currently exists to compensate market-wide injuries resulting from worldwide anticompetitive conduct is class actions under United States law.
