Overview
Milberg's bankruptcy practice group augments its litigation practice and renders services to clients who are increasingly facing issues in the areas of bankruptcy and insolvency. 

The Firm's bankruptcy practice focuses on two areas.  One is representation of clients in specialty bankruptcy litigation by trustees, chapter 11 debtors, litigation trustees, creditors' committees and individuals.  This practice complements the Firm's practice in class action litigation, and offers the Firm's broad litigation capabilities to parties injured by fraud, breaches of fiduciary duty, excessive compensation,  malpractice, and financial wrongdoing as well as clients with claims under the fraudulent transfer and bankruptcy provisions of federal bankruptcy law and state law for avoidable transactions such as failed LBO's, excessive compensation, insider dealings and transactions while insolvent.

The Firm's other area of practice in this area is representation of clients such as debtors, committees, groups of creditors, creditors, holders of equity interests in all aspects of bankruptcy cases and related litigation.  This practice includes representing clients in filing such cases, participating in all aspects of such cases and related litigation, and representing clients who seek to engage in a transaction with a debtor such as a purchase of assets or some form of restructuring or m&a transaction within such cases.  This also includes representation of clients in out of court workout and restructuring transactions.

Milberg's bankruptcy practice is headed by Jonathan M. Landers, and includes partners Matthew GluckSanford Dumain and Brad Friedman, who collectively have many decades of experience in dealing with the broadest possible range of bankruptcy matters.  The Firm also offers capabilities which are somewhat unique to bankruptcy cases.  These include minimal conflicts issues because the Firm does not have significant "institutional client" relationships, the willingness to handle matters on a full or partial contingency basis, and an internal staff of investigators and forensic accountants which results in efficiencies in handling a case and reduces time and expense.

Milberg's bankruptcy practice group is playing an important role in the Madoff bankruptcy case on behalf of a long list of Madoff customers, and will play an increasingly important role in representing the victims of wrongdoing in bankruptcy matters of all types.
